Cleveland Browns linebacker Devin Bush was found not guilty of simple assault and harassment on Tuesday stemming from a May incident with his girlfriend, according to court records.

Bush, 27, was arrested earlier this year after his girlfriend alleged he assaulted her, smashed her phone and took her car keys. Police said in May that Bush admitted to breaking the phone, but denied getting physical with her.

In a statement to The Athletic, Bush’s attorney Robert G. Del Greco Jr. said testimony at the trial indicated that “the putative victim of the domestic violence was electronically and surreptitiously intercepting the oral communications of Devin Bush.”

“When Mr. Bush learned of this interception, he voiced his objection, but the interception continued.” Del Greco said. “Mr. Bush removed and broke his phone that was the mechanism of the electronic interception.”

The NFL and the Browns did not immediately respond to requests for comment Wednesday.

Bush was a 2019 first-round pick of the Pittsburgh Steelers. After four seasons with the Steelers, Bush spent 2023 with the Seattle Seahawks. He is in his second season with the Browns after signing a new one-year contract to remain in Cleveland in March.

In 14 games for the Browns this year, Bush has recorded 93 tackles, two sacks and two interceptions. He also forced a fumble in a Week 3 win against Green Bay.
